Abstract
En Argentina, la Ley de Educación Superior (LES; Ley 24.521, 1995) establece que hay profesiones cuyo ejercicio puede comprometer el interés público poniendo en riesgo de modo directo la salud, la seguridad, los derechos, los bienes o la formación de los habitantes, y las mismas están contempladas en el artículo 43 de la LES. Sólo aquellas actividades que realicen estos profesionales y que implican un riesgo rigurosamente directo, se denominan actividades profesionales reservadas. Pero… ¿Cuál es la diferencia entre actividades profesionales reservadas y alcances de los títulos? ¿Y cómo se establecen? El objetivo de este trabajo es analizar el significado e implicancia de las actividades profesionales reservadas en Argentina, marcando la diferencia con los alcances de los títulos, haciendo foco en las carreras universitarias de Bioquímica y Farmacia. Asimismo, proporciona un marco histórico en el que se establecen las actividades profesionales reservadas y las acreditaciones de las carreras universitarias. Sostenemos que si bien debe aplicarse un carácter restrictivo y riguroso a la hora de calificar carreras cuyo ejercicio genera riesgo social, el ingreso al artículo 43 de la LES no define una mayor jerarquía respecto de otras carreras ni indica que éstas representen un grupo de mayor importancia que las otras. Entender los significados de las actividades reservadas y los alcances de los títulos fomentan claridad a la hora de dirimir las actividades que podemos realizar los profesionales con determinada titulación y resulta fundamental para el adecuado desempeño profesional.
In Argentina, the Law of Higher Education (LES; Law 24,521, 1995) establishes that there are professions whose exercise may compromise the public interest, putting at risk the health, safety, rights, property or formation of the inhabitants, and they are contemplated in article 43 of the LES. Only those activities that these professionals carry out and that involve a strictly direct risk are called reserved professional activities. But… What is the difference between reserved professional activities and the scope of the professional degrees? And how are they established? The objective of this work is to analyze the meaning and implication of the professional activities reserved in Argentina, highlighting the differences with the scope of the professional degrees, focusing on university degrees in Biochemistry and Pharmacy. It also provides a historical framework in which the reserved professional activities and the accreditation of university degrees are established. We believe that although a restrictive and rigorous analyses should be applied when qualifying careers whose exercise generates social risk, the entry to the article 43 of the LES does not define a higher hierarchy compared to other careers nor does it indicate that these represent a group of greater importance than the others. Understanding the meanings of the reserved activities and the scope of the titles promote clarity when deciding on the activities that we, as professionals with a certain degree, can carry out and is essential for proper professional performance.
